Marejai's Terms of Service and Use

The Client must read and agree to these Terms of Service prior to ordering a commission. By sending the payment, the Client agrees to the terms above. Breaking the Terms of Service will result in the Client being blacklisted and the commission cancelled.

I will draw:

  • Dragons and other fantastical creatures

  • Animals and furries

  • Humans and humanoids

  • Original and fan characters

  • Fanarts

  • Natural landscapes

  • Cartoony style art

  • LGBT art

  • Light Gore

I will not draw:

  • Realistic portraits

  • Robots or vehicles

  • Artificial landscapes, such as cities

  • Nudity or sexual content

  • Excessive gore

  • Hate or Revenge Art

1. General

  • By sending the payment, the Client agrees to the Artist's Terms of Service and states that they are 18 years old or older and using their own paypal account and their own money.

  • These terms are for non-commercial digital illustration commissions and are a subject to changes without notification.

  • The Artist reserves the right to decline any commission and to make exceptions.

  • The Artist reserves the right to cancel any commission at any point for any reason, which may not necessarily be disclosed.

2. Payments and Refunds

  • Full payment is expected up front via paypal invoice for commissions below 30€. For commissions above 30€ the client has the right to split the payment, half before the Artist starts working on it, and the other half once the Client has approved the sketch.

  • The Artist will not start working on the commission until payment is sent.

  • The Client will receive a full refund if the Artist has not started working on the commission or if the Artist cancels the commission.

  • If the Client cancels the commission after the Artist has already started working on it, the Client will not receive a refund.

  • If the commission is cancelled, the Client may not use, edit, repost, finish or have someone to finish any WIP images or designs they may have received.

  • The Client will not receive a refund if the commission is completed.

3. Image Rights

  • The Artist reserves the right to display commissioned artwork on any of their personal galleries or portfolios.

  • Nothing made by the Artist may be used in any blockchain related technology, including NFTs, cryptocurrency or future inventions in the space.

  • The Client may request for the commission to remain private or not to be posted, but this must be discussed when ordering the commission.

  • The Artist reserves all rights to the commissioned art, WIPs and sketches. Copyrights and ownership of characters displayed on the commissioned artwork will remain to their owners.

  • The Artist has all rights to declined/cancelled sketches, designs and projects and may repurpose or resell them

  • The Client may not use, repost, edit, finish or have someone to finish declined sketches, designs, WIPs.

  • The Client may use commissioned artwork for non-commercial/non-profit, personal use only, for example icons,wallpapers, etc.

  • The Client may display the smaller version of the commissioned artwork on their personal galleries as long as proper credit is given to the Artist.

  • The Client may use the full size version of the commissioned artwork for personal, private use only and may not post the file anywhere.

4. Design Rights

  • The designs commissioned and bought from the Artist are for limited commercial use.

  • The Client is not buying full commercial rights to the design.

  • The Client may sell prints of their own artwork featuring the design.

  • The Client may not use the design for commercially publised games, books, etc,

  • The Client may not use the original art made by the Artist for commercial use.

  • The Client may resell the design but the Artist must be informed of this beforehand.

  • The Client may not claim the design as their own work.

5. Editing

  • The Client may request any revisions during sketch phase for free. After that, additional revisions will be charged extra according to complexity.

  • Major changes are possible only during sketch phase. Once sketch has been approved, only minor changes are possible.

  • The Client is responsible for providing all relevant information and up-to-date, clear references for the characters when submitting an order form.

  • The Artist is not at fault for any mistakes due to the provided reference being out-of-date, missing details, not clear or if relevant information was not provided. Fixing these mistakes may incur an additional charge.

  • The Artist will fix mistakes that occur by the Artist's fault, such as missing a detail on the reference, without additional charge.

  • The Client or any other person may not edit the artwork without getting a permission from the Artist.

6. Communication, Deadlines and Delivery

  • The Artist can be contacted on their Twitter Instagram pages via private messages or through Discord.

  • The Artist will update the Client on the progress of their commission by sending work-in-progress (WIP) pictures of the artwork on different phases of the work. The Artist will also inform the Client on any delays.

  • The Client may request WIPs at any point but please do not ask for updates daily/several times a week.

  • Frequently messaging me or demanding responses and/or updates will result in a warning. If this warning is ignored, this will be considered a breach of contract and further collaboration will be discontinued. No refund will be given.

  • Harassment and abuse will not be tolerated and will result in immediate termination of the contract, with further communication permanently discontinued. No refund will be given.

  • The turnaround time for commissions is 1 month on average from when the Artist has started working on the commission.

  • The Artist may finish the commission faster or slower depending on the commission type, technical problems, health issues, long queue, vacation etc.

  • Deadlines must be mentioned upon ordering. The Artists reserves the right to decline commissions with too short deadlines and to refuse deadlines mentioned after the commission has been paid for.

  • The WIPs will be delivered to the Client via private messages and the files for the completed artwork will be sent to the Client’s email. The completed artwork will be a digital illustration and a physical copy will not be shipped to the Client.

  • A smaller version of the completed artwork will be posted on the Artist's personal galleries unless the commission has been requested to be kept private.

  • The Artist will not provide psd. or unwatermarked files of the completed artwork.
